Brazil Section 301 tariff is now in force at 25% for covered imports
Updated · Impact score 74/100 · Confidence 55%
USTR's final Section 301 action now applies a 25% duty to covered products of Brazil entered for consumption, or withdrawn from warehouse for consumption, from 12:01 a.m. eastern time on July 22. CBP has issued entry-filing guidance and the corresponding HTS list; the separate Section 122 surcharge is scheduled to end at 12:01 a.m. EDT on July 24.
Why it matters
The new Chapter 99 duty generally stacks with ordinary duties and applicable AD/CVD, while the notice exempts extensive HTS lines and specified categories. CBP confirms the Chapter 99 reporting sequence, but heading 9903.03.01 should not remain on post-cutoff entries unless an official extension or replacement changes the Section 122 end date.
What to check next
Give CBP's HTS attachment and filing sequence to your broker, remove heading 9903.03.01 from entries after the July 24 cutoff unless official guidance extends it, confirm whether HTSUS 9903.05.01 or an exemption heading applies, and preserve proof for qualifying Brazil in-transit cargo before July 29.
