Canada fresh-mushroom AD/CVD cases move to the USITC final phase

The U.S. International Trade Commission scheduled the final phase of antidumping and countervailing-duty injury investigations covering fresh mushrooms from Canada. The scheduling notice was published August 4, 2026 and follows Commerce's preliminary affirmative subsidy and less-than-fair-value determinations.

The written scope covers fresh mushrooms of the genus Agaricus, including whole mushrooms and mushrooms sliced, diced, or separated into stems and pieces before importation. It reaches bulk and retail packaging, organic and non-organic product, and mushrooms for the fresh market or food processing. The merchandise is currently classifiable under HTSUS 0709.51.01, but the written description controls.

Commerce's preliminary countervailing-duty determination took effect May 18. It listed preliminary subsidy rates of 1.62 percent for Champ's Fresh Farms, 4.97 percent for Farmers' Fresh Mushrooms, and 2.84 percent for all others, and directed CBP to suspend liquidation and collect preliminary deposits according to the applicable producer/exporter instructions.

Commerce's preliminary antidumping determination took effect July 17. It listed preliminary dumping margins of 8.71 percent for Champ's/Loveday, 2.00 percent for the Farmers' Fresh group, 11.80 percent for Highline, and 8.26 percent for all others. Commerce directed CBP to suspend liquidation and collect preliminary antidumping deposits from the publication date and extended the antidumping provisional-measures period to no more than six months.

The USITC scheduling notice does not create a final duty order. It sets a prehearing brief deadline of November 12, a hearing beginning at 9:30 a.m. on November 17, and a November 24 deadline for posthearing briefs and nonparty written statements. Parties may submit final comments on newly released information by December 16 under the notice's stated restrictions.

Action items

• Screen Canadian fresh Agaricus mushrooms using the complete written scope; do not rely only on HTSUS 0709.51.01.
• Match both exporter and producer to current CBP cash-deposit and suspension instructions before entry because the preliminary rates are company-specific.
• Verify current ACE and CBP instructions for entry dates affected by provisional-measures timing rather than assuming the preliminary treatment remains unchanged indefinitely.
• If participating in the final injury phase, coordinate the appearance, hearing, brief, and service requirements with qualified trade counsel.
